1. Contracting party and acceptance
These terms are between you and Par & Par Limited, company number 111345, trading as ZipCart, Gadget Station, The Gadget Shop and Deals Gibraltar (we, us or our), at 280 Main Street, GX11 1AA, Gibraltar. By creating an account or placing an order through ZipCart, you agree to these terms. You must be aged 18 or over, have legal capacity to contract and provide accurate information.
2. Accounts and security
Use a telephone number or email address you are entitled to verify and keep access secure. You are responsible for activity through your account except activity caused by our failure to use reasonable security. Tell support@zipcart.delivery promptly if you suspect unauthorised access. We may proportionately restrict access for security, fraud prevention, non-payment, abuse, threats or unlawful use without excluding mandatory rights.
3. Products, stores and availability
ZipCart connects customers with products fulfilled from participating stores. Available products, prices, service areas, delivery slots and collection options depend on current store, stock, location and operational capacity. Packaging and minor details can change. We may correct an obvious error, limit quantities, remove a product or reject an order before acceptance. If a correction materially affects a paid order, we will provide the appropriate remedy.
4. Orders and substitutions
Placing an order is an offer to buy. An acknowledgement confirms receipt, not necessarily acceptance. Acceptance occurs when we confirm it or fulfilment starts. We may lawfully decline or cancel for stock, service-area or capacity limits, failed payment or fraud checks, an obvious error, or age-restricted requirements. Where the app offers a substitution, you can accept or reject it through the available control.
5. Prices, fees and payment
Prices are shown in GBP or EUR, as applicable. The product total and every applicable delivery, handling, service, small-order or other charge, discount, wallet application and voluntary tip are shown before confirmation. Stripe processes card, Apple Pay and Google Pay payments; complete card credentials are entered into Stripe's interface and are not stored by us. ZipCart may also apply available wallet balance. You authorise the displayed total.
6. Cancellation
You may cancel only while the order is in a cancellable state shown in the app. Once picking, preparation or delivery has progressed, cancellation may no longer be available. We may cancel an order that cannot be fulfilled and will arrange the applicable refund. Cancellation rights required by law are unaffected.
7. Refunds and wallet
Refunds follow the original funding split where possible: wallet-funded amounts return to the ZipCart wallet and card, Apple Pay or Google Pay amounts are refunded through Stripe. If a provider refund fails, we may apply an equivalent recorded wallet credit and will tell you. A provider may take additional time to display a refund. Wallet credit currently has no expiry; we will give advance notice and update the terms before introducing one. The Returns and Refunds Terms explain issue reporting and remedies.
8. Delivery and collection
The address, store or collection point, available option, fee and current estimate are shown before confirmation. Estimates depend on distance, demand, stock, picking and operational conditions and are not guarantees. You must provide accurate contact and access details and be available to receive the order. 9. Communications and marketing
We may send security codes, receipts, order progress, delivery updates and support messages needed to operate ZipCart. These service communications are not marketing consent. Marketing push notifications are sent only where the applicable consent exists, and you can withdraw it in Profile → Notifications without affecting service messages.
10. Acceptable use and submitted content
You must not misuse ZipCart, attempt unauthorised access, interfere with the service, introduce malicious code, create fraudulent orders or refunds, threaten staff or delivery personnel, infringe another person's rights, or use ZipCart unlawfully. Content you submit must be lawful and yours to submit. You retain ownership and grant us a non-exclusive licence to host, use and review it for operating, supporting and improving the service.
11. Privacy and deals.gi
Par & Par Limited also operates deals.gi. The ZipCart Privacy Notice explains how deals.gi and Deals Gibraltar app orders are copied into ZipCart systems, how records may be matched using verified contact details, the providers involved, retention and your rights.
12. Our responsibility
We do not exclude liability where unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights. Subject to that, we are not responsible for unforeseeable loss, loss caused by your breach, business loss arising from consumer use, or delay outside reasonable control where the law permits this limitation.
13. Changes, termination and severability
We may update these terms for future use when the service, technology or legal obligations change. The terms in force when an order is placed govern that order unless law requires otherwise or you agree. You may stop using ZipCart and request account deletion; some transaction records remain under the Privacy Notice. Order and delivery records are kept for 6 years as accounting records. If a provision is unenforceable, the others continue.
14. Governing law and courts
These terms and any non-contractual dispute are governed by the laws of Gibraltar. Gibraltar courts have jurisdiction without removing any mandatory protection or forum right given by applicable consumer law.
If you are unhappy with how we use your personal information, you have the right to complain to the Gibraltar Regulatory Authority, which supervises data protection in Gibraltar.
